Negligent homicide charge filed

Almost one year to the day of the incident, a Lavaca woman was charged with negligent homicide for the death of a Magazine man, which occurred during a single vehicle accident on North State Highway 109 in Magazine.

Jayla N. Weaver, 22, was charged with the Class B felony negligent homicide and driving while intoxicated as a result of the May 30, 2019 accident.

According to an Arkansas State Trooper’s arrest warrant affidavit, he was advised Weaver was the driver of the 2012 Chevrolet vehicle involved in the accident and at that time on Highway 109 and that Tyler D. Wendt, 27, was the passenger.

The Trooper was also advised of the smell of intoxicants by a Logan County Deputy Sheriff who arrived on the scene first, and was shown where Weaver was thrown through the windshield of the vehicle.

The Trooper located beer cans behind the passenger seat, the affidavit adds.

The Trooper’s accident investigation determined that, for an unknown reason, at about mile marker 0.43 the vehicle Weaver was driving left the roadway to the right, crossing a gravel roadway and traveling 375 feet before it collided with two trees on the east side of the highway.

The first tree was swiped and the second, 30 feet away, was hit head on, the affidavit continues, after which time the vehicle traveled another 37 feet before coming to a stop in the highway.

Both Weaver and Wendt were transported to Mercy Hospital where Wendt was pronounced dead. Weaver was further transported to UAMS in Little Rock.

Due to her critical condition the Trooper was unable to obtain a statement or a blood sample from Weaver at the hospital, the affidavit states, but a sample was obtained through a prosecutor’s subpoena.

When tested, the blood alcohol level was 0.11 percent, according to the affidavit.
